A Southern Illinois senator says the proposed law that would force gun owners to pay to register their handguns is likely dead for now.
State Sen. Gary Forby, D-Benton, said important deadlines for moving the two bills, one in the Illinois House and one in the Senate, passed last week without any action from proponents of the measures.
Bill proposals were drafted earlier this year upon the request of Chicago Mayor Rahm Emanuel, who sought to use the measure to fight gun crimes in the city.
Forby and other local legislators fought the measure on grounds it penalized legal owners of firearms with extra expenses. Lawmakers launched a petition drive that collected more than 13,000 signatures.
“We won this fight. The thousands of people who signed our petitions, visited Springfield on Gun Owner Lobby Day, called and wrote to their senators and representatives,” Forby said. In the end, Forby said, the sponsors knew they could not win.

April 5, 2012 (CHICAGO) (WLS) -- The Illinois Supreme Court will give its decision Thursday on the constitutionality of Cook County's assault weapons ban named after slain Chicago teenager Blair Holt.
Opponents argued the ban is too vague and violates the Second Amendment. They also believe the ordinance should be reconsidered in light of the 2010 U.S. Supreme Court case that overturned Chicago's ban on handguns.
The county ordinance outlaws the sale or possession of "any assault weapon or large capacity magazine."

State Supreme Court revives challenge to Cook Co. assault weapon ban
Gun rights advocates scored a victory Thursday when the Illinois Supreme Court decided to let a challenge to Cook County's assault weapons ban proceed, even though two lower courts had tossed it out.
The Supreme Court, in a unanimous ruling, said it wants the trial court to hear evidence on whether assault weapons get the same Second Amendment protections as handguns.

House Resolution Number 89 required the Office of the Auditor General to conduct a management audit of the Illinois State Police’s (ISP) administration of the Firearm Owners Identification Card (FOID) Act. Our audit concluded that the effectiveness of the FOID card program is limited in promoting and protecting the safety of the public.
There are significant deficiencies in the reporting of individuals with potentially disqualifying mental health conditions to ISP. During 2010, only 3 of the 102 circuit court clerks (3%) submitted mental health court orders to ISP as required by the Act. As a result, ISP did not receive the information needed from the circuit court clerks to revoke or deny FOID cards. Due to the lack of reporting by circuit court clerks in Illinois, ISP could not report all individuals adjudicated as a “mental defective” or “intellectually disabled” (terms used by the
Act) to the FBI’s National Instant Criminal Background Check System (NICS), as required by the Act. Fifty-six of the 121 (46%) orders received from circuit court clerks during 2010 did not contain information determined by ISP to be necessary, including date of birth, gender, or race. We found that 27 of the 121 (22%) orders from the circuit court clerks were not reported to NICS.
Mental health admissions data received by the Department of Human Services from private hospitals and nursing homes did not make the distinction between voluntary and involuntary admission; therefore, ISP could not report any individuals with disqualifying mental health admissions (i.e., adjudicated involuntary admissions) from private hospitals or nursing homes to NICS.
Our audit also found that:
• The Illinois State Police’s Firearms Services Bureau did not approve all FOID cards in the required 30 days for the 903,139 applications received during 2008, 2009, and 2010. Over the three year period, 566,616 of 879,906 (64%) applications were approved within 30 days. In 2008, 40 percent of cards were approved within 30 days. The processing times improved to 80 percent in 2009 and decreased to 70 percent in 2010.
• ISP did not deny all FOID card applications in the required 30 days. For applications received during 2008, 2009, and 2010, ISP denied 20,152. Over the three year period, 71 percent of the denied FOID cards were denied within the required 30 days.
• During 2008, 2009, and 2010, the ISP recorded 21,212 reasons for revocations of FOID cards for 20,227 cardholders. ISP officials estimated that only 30 percent of revoked FOID cards are returned to ISP.
• ISP did not have enough Customer Service Representatives to handle the volume of calls that are received by the Bureau related to the FOID card program. According to call logs provided by ISP, during the last quarter of 2010, 25,131 of 29,420 calls (85%) were not answered by ISP.
• According to documentation provided by ISP, from July 1, 2009, through June 30, 2011, the State Police spent $526,919 on overtime for FOID card processing.

The Adams County Board will take up a Concealed Carry advisory resolution next Month!
John Brady (R-6th District) made the motion, saying he had discussed the matter with State’s Attorney Jon Barnard.
Brady mentioned the overwhelming support that an advisory ballot question had in Pike County last month, passing by a vote of 3,214 to 550.
It passed on a voice vote, but one member, Nick Peters (D-District 1,) loudly shouted his ‘no’ vote. Peters is also the Chairman of the Adams County Democratic Party.

Gov. Mark Dayton on Monday signed a bill allowing county attorneys and assistant county attorneys to carry firearms on duty as long as they have a valid permit. County attorneys can impose restrictions in their respective offices.
The bill cleared the Legislature on overwhelming votes. The bill gained steam after Cook County Attorney Tim Scannell was shot and wounded in December last year by a man he had successfully prosecuted. The new law takes effect Tuesday.

JEFFERSON CITY, MO — State House members have approved a proposed amendment to the Missouri Constitution guaranteeing the right to own and manufacture ammunition.
The state constitution currently protects the right of Missourians to bear arms to defend themselves, their homes and their property.
The proposed amendment would add new protections for the right to possess, purchase, reload and manufacture ammunition. It also would allow people to manufacture or purchase parts needed for firearms to work properly.
House members endorsed the measure 121-31 on Tuesday. It needs another vote before moving to the state Senate, and could go on the statewide ballot later this year.

Introduced to the Senate as S. 2188 by Sens. Mark Begich (D-Alaska) and Joe Manchin (D-West Virginia) on March 13.
The bill would allow any person with a valid state-issued concealed firearm permit to carry a concealed handgun in any other state that issues concealed firearm permits, or that does not prohibit the carrying of concealed firearms for lawful purposes. A state’s laws governing where concealed handguns may be carried would apply within its borders.
The bill is the Senate companion to H. R. 822, which was approved by the U. S. House last November in a 272-154 vote after similar measures proposed since 1995 failed.

Morgan Griffith (R-Va.), Ted Poe (R-Texas) and Bill Owens (D-N.Y.), this bill would make it illegal for local authorities to detain or arrest travelers who make every effort to comply with federal law when legally transporting their firearms between locations where they are legally allowed to possess them.
The Firearms Owners’ Protection Act (FOPA) in 1986 already provides this federal protection, but some local jurisdictions use state licensing laws to harass and prosecute travelers in transit with checked firearms. The problem is particularly acute in New York City and New Jersey.
This exploitable loophole will close if the Senate passes the National Right-to-Carry Reciprocity Act of 2012. If it doesn't, this reiterated refinement of FOPA will make it illegal to arrest someone for following federal law.
- HR 308, The Large Capacity Ammunition Feeding Device Act
Since introducing this bill to House Judiciary Committee with 111 co-sponsors in January 2011, momentum for McCarthy's defacto AWB renewal has stalled.
The bill would ban the manufacture and importation of new magazines that can hold more than 10 rounds of ammunition. Unlike the 1994 to 2004 automatic weapons ban, this bill would also make it illegal to sell or otherwise transfer "high-capacity" magazines, even through inheritance.
