BELLEVUE, WA – -(Ammoland.com)- A federal court judge in Illinois has denied a City of Chicago motion for summary judgment and refused to dismiss a case challenging a ban of firearms sales within city limits that is backed by the Second Amendment Foundation.

It is the latest in a string of court battles between Chicago and SAF, causing SAF founder and Executive Vice President Alan M. Gottlieb to observe;

“We’ve already beat Chicago three times, in the McDonald case before the Supreme Court, and both Ezell 1 and Ezell 2 before the federal court of appeals. I’m reminded of the folk song by Peter, Paul and Mary that asked, ‘When will they ever learn’?”

The case involves a proposed gun shop called Second Amendment Arms (SAA), owned by R. Joseph Franzese, who submitted an application for a business license in July 2010. The city contends that the application was for an address in an area not zoned for commercial use, but Franzese argues that he was not advised about the zoning and that it had been advertised as commercial property. Besides, he contended that the city’s prohibition on gun sales “would have blocked (their) efforts no matter where (they) chose.”

“The City of Chicago under Rahm Emanuel is trying to be too clever by half,” Gottlieb said. “We would have thought by now that they would have ceased this pattern of spending tens of thousands of taxpayer dollars on stubborn litigation, but the city seems determined to be dragged kicking and screaming into compliance with the Second Amendment.

Cardinal Blasé Cupich signed a new policy that clarified language to make it clear that guns will not be allowed in churches, schools, or any property owned by the archdiocese.

The policy, which goes into effect Thursday, states that churches, schools and administrative facilities are intended to be sites where people can gather, pray and worship in safety and peace.

A measure to repeal Cook County’s controversial sweetened-beverage tax was introduced to the Cook County Board on Wednesday, and after lots of comments from opponents and supporters, commissioners voted to send the matter to its Finance Committee.

Supporters of repeals say the tax is driving business out of the county, but they failed to get the nine commissioners they needed to vote to bypass the committee and put the repeal up for a vote Wednesday. The Finance Committee isn’t scheduled to meet until next month.

Crossbows can be used to hunt deer and turkey in Illinois thanks to a new state law that was signed last week.

On Friday, Gov. Bruce Rauner signed a bill that amends the Illinois Wildlife Code to repeal restrictions on the use of crossbows during archery hunting seasons. State law previously allowed crossbows for archery hunting only by those ages 62 and older, and by people with disabilities who qualified for a crossbow permit, according to the Illinois Department of Natural Resources. The previous law also allowed certain youth hunters to use crossbows.

The Republican-controlled Senate Judiciary and Public Safety Committee voted 3-2 along party lines Tuesday to pass the measure. Democrats objected, saying it didn’t make sense to allow for the carrying of deadly weapons without any training or licensing requirements.

“This bill supports the people who want to weaken firearms laws, and I think we should strengthen them,” said Democratic Sen. Fred Risser, of Madison. “We have a problem in this country with too much liberalization of firearms laws and this just adds to it.”

Current state law requires anyone who carries a concealed weapon to obtain a permit and get training. The bill retains that license for people who want to obtain it, but also allows for the carrying of a concealed weapon without obtaining a permit.

After gaining traction in several states last legislative session, permitless carry is now picking up steam in Wisconsin.

Earlier this week, a Senate committee voted along party lines to pass SB 169, which removes the licensing requirement for those who want to carry a concealed firearm for self-defense. The National Rifle Association is strongly supporting the measure.

The bill was introduced earlier this year by state Sen. David Craig and state Rep. Mary Felzkowski, and boasts 39 co-sponsors.

“We already give people the ability to openly carry a firearm without a license,” Sen. Craig said in a statement when announcing the legislation. “With this bill, law-abiding citizens will have the same right to carry discreetly that they currently have to carry openly.

“If you decide to throw on a coat, you should not be considered a criminal.”

ALTON - House Bill (HB) 4107 was introduced to the Illinois General Assembly by Representative Martin J. Moylan (D-Des Plaines) on Oct. 5, 2017, in the wake of the tragic Vegas shooting to effectively ban the sale of assault rifles in Illinois.

The bill would amend the Illinois Criminal Code of 2012 and would make it unlawful to "deliver, sell, or purchase or cause to be delivered, sold, or purchased or cause to be possessed by another, an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge," according to a synopsis on the Illinois General Assembly website, www.ilga.gov.

If passed, the ban would also make it unlawful for "anyone to knowingly possess an assault weapon, .50 caliber rifle, or .50 caliber cartridge 300 days after the effective date of this amendatory act" with the exception of weapons registered with the Illinois State Police in the time provided.

Here in Illinois, there is a push to toughen gun laws.

On Wednesday, state representative and candidate for attorney general Scott Drury, introduced a bill to ban bump stock. Drury said he intentionally limited the legislation so that lawmakers will have to answer yes or no on whether they support bump stocks.

The Illinois State Rifle Association opposes a state solution to bump stocks. They’d rather the AFT take a look.

“The ATF can review their decision, take comments, and they can regulate them that way. There’s no need to make 50 different laws,” Richard Pearson, Illinois State Rifle Association, said.

The gun control talk only goes so far. This Friday, Illinois gun rights supporters will be flexing their muscles. The Lake County Republicans are holding a “Second Amendment Dinner and Gun Raffle.”

A $2,000 sponsor gets an AR-15 rifle.

Critical legislation that will improve your ability to defend yourself may be voted on in the Wisconsin state Senate this month. Senate Bill 169 will allow for the concealed carry of a firearm without a concealed carry license anywhere in the state where an individual is legally allowed to be. Please contact your senator and urge them to SUPPORT this important Right to Carry legislation.

SB 169 would also expand the list of places where firearm owners can legally carry and make the current concealed carry licensing system optional. This allows citizens to obtain a license and take advantage of reciprocity agreements with other states.

Self-defense situations are difficult, if not impossible, to anticipate. Accordingly, a law-abiding adult’s right to defend themselves in such situations should not be conditioned by government-mandated time delays and taxes.

SB 169 would eliminate these government mandates and allow individuals to carry in a manner that best suits their needs. Under current law, an individual can carry a firearm openly without a concealed carry license; however, if an individual would rather carry their firearm in a purse or briefcase, or if their firearm becomes covered by a coat, they would be in violation of current concealed carry laws unless they obtained a concealed carry license. This bill recognizes a law-abiding adult’s unconditional Right to Keep and Bear Arms for self-defense in the manner he or she chooses. Further, twelve states currently have similar Right to Carry laws which allow law-abiding individuals to possess a concealed firearm for self-defense without a permit.

The Illinois General Assembly will gather for its fall veto session on Tuesday with gun control legislation to consider again in light of national tragedy, including a provision to ban "bump stocks," the devices used by the gunman in what is now the deadliest mass shooting in modern U.S. history.

At least two bills are being considered following the shooting in Las Vegas that left 58 people dead and more than 500 wounded on Oct. 1.

House Bill 4107 introduced Oct. 5 by state Rep. Martin Moylan, a Des Plaines Democrat, would ban the sale of bump stocks, as well as assault weapons, large-caliber rifles and large-capacity magazines, described in the bill as holding 10 or more rounds of ammunition. Senate Bill 1657 would create state licensing for gun dealers and was filed by state Rep. Kathleen Willis, a Democrat from Addison.

The Illinois State House of Representatives “soundly rejected” a bill to ban bump stocks Thursday. The legislation, sponsored by Democrat State Rep. Martin Moylan, would have also banned a substance called tannerite that is used at many shooting events to create explosions when a target is hit.

The Chicago Sun-Times reported a competing measure, sponsored by Republican State Rep. Barbara Wheeler, would only ban bump stocks. It is supported by the Illinois State Rifle Association, the newspaper said.

Moyland will reportedly try again with his legislation.

The Alliance is claiming in its email that lawmakers want to “explore public health solutions to curb the gun crisis.”

Both high-crime and trendy Chicago neighborhoods see surge in carjackings

With gun violence garnering unflattering national attention for Chicago, carjackings have quietly gone off the charts as well. While shootings and homicides are largely concentrated in impoverished pockets of the South and West sides, carjackings are occurring throughout the city, including the downtown area, Chicago police statistics show.

Last year Chicago recorded 663 carjackings, nearly double the 339 in 2015 and the most since 2009, according to the department. And the numbers have shot up even further so far this year. Through Oct. 18, the latest date available, carjackings have totaled 661, nearly equal to all of 2016 and a 44 percent spike from the same period a year ago.


"We strongly encourage anyone who may be a victim of a potential carjacking to be as attentive as possible and remember any notable descriptions about offenders and surroundings," Guglielmi said. "Try to avoid struggles over the vehicle or any property and immediately report the incident to 911."

Many incidents this year have been of the "bump-and-run" variety, when would-be robbers purposely hit cars to get drivers to stop so they can take the cars.
